Biography:

Dan Klingenberger represents large and small companies in all forms of employment litigation, including wrongful termination, sexual harassment, class actions, unfair competition/trade secret issues, wage and hour claims, and discrimination. He provides employers with creative and effective advocacy in the defense of such claims. His litigation experience includes jury and bench trials in State and Federal Courts.

Dan defends claims filed with many administrative agencies, including the Division of Labor Standards Enforcement, Cal/OSHA, Department of Fair Employment and Housing, Equal Employment Opportunity Commission, Workers' Compensation Appeals Board and the Employment Development Department. Dan has represented companies in hearings conducted by each of these government agencies.

Dan advises employers on day to day labor and employment law matters to develop effective and practical ways to deal with challenging employee issues. He assists employers with developing tools to manage employment law matters. Such tools include employee handbooks, employment agreements, commission agreements and severance agreements.

For clients who face challenges dealing with unions, Dan provides advice on union avoidance, labor arbitrations, union elections and unfair labor practice charges filed with the National Labor Relations Board.

In addition, Dan is extensively involved with training supervisors and owners on employment law matters, including unlawful harassment prevention training, union avoidance and workplace violence. Dan is a frequent speaker before business and professional groups.

Terms & Agreements

Registration may close seven calendar days prior to a training session.

Cancellations received up to ten calendar days prior to the training session or beginning of the training series are refundable, less an administrative/materials fee.

After that time, cancellations are subject to the registration fee.

Publicity and Photo Release Agreement

I hereby grant to P•A•S Associates the absolute and irrevocable right and unrestricted permission to use my name, likeness, image, voice, and/or appearance as such may be embodied in any photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of P•A•S Associates. 

I agree that P•A•S Associates has complete ownership of such material and can use said material for any purpose consistent with P•A•S Associates' mission. These include, but are not limited to:

  • Videos,
  • Publications,
  • Advertisements,
  • News releases,
  • Web sites, and 
  • Any promotional or educational materials in any medium 

I acknowledge that I will not receive any compensation for the use of such images, video, likeness, etc.

I hereby release and discharge P•A•S Associates, and its agents, representatives and assignees from any and all claims and demands arising out of or in connection with the use of my name, likeness, image, voice and/or appearance, including any and all claims for invasion of privacy, right of publicity, misappropriation or misuse of image, and/or defamation.

I represent that I am over the age of eighteen (18) years and that I have read the foregoing and fully understand its contents. This release shall be binding upon me, my heirs, legal representatives, and assigns.

This agreement is being made and entered into under the laws of the State of California and shall be governed and interpreted in accordance with the laws of said state. This agreement embodies the entire agreement of the parties (subject and photographer). No modification of this agreement shall be of any effect unless it is made in writing and signed by all of the parties to the agreement.
